Terms and Conditions

Effective Date: September 26, 2026

These Travel Booking Terms & Conditions govern the travel planning, advisory, curation, reservation, and booking services provided by The Lux Experience.

By requesting, confirming, or paying for a travel reservation or Service through The Lux Experience, you acknowledge that you have read, understood, and agree to these Terms.

These Terms should be read together with any applicable supplier terms and conditions, cancellation policies, fare rules, hotel or resort policies, tour operator terms, cruise line terms, airline conditions of carriage, travel insurance policy terms, and other terms applicable to the services you purchase.

1. Our Role as a Travel Advisor

The Lux Experience is a Maryland-based travel advisory and travel-planning business. We assist clients with travel research, planning, curation, reservations, and other travel-related services.

Depending on the particular reservation and payment arrangement, The Lux Experience may act as a travel advisor, booking intermediary, or authorized representative of a Travel Supplier or affiliated travel organization.

Travel services may be provided by independent third-party suppliers, including airlines, hotels, resorts, cruise lines, tour operators, transportation companies, activity providers, destination management companies, travel insurance providers, and other travel-related businesses (“Travel Suppliers”).

Unless expressly stated otherwise in writing, The Lux Experience does not own, operate, control, or manage the Travel Suppliers or the travel services they provide.

Travel Suppliers are independent businesses and are responsible for the services they provide, including their schedules, facilities, personnel, policies, cancellations, changes, and performance.

Your purchase of travel services may therefore create a direct contractual relationship between you and the applicable Travel Supplier.

Nothing in these Terms is intended to misrepresent the legal relationship between The Lux Experience, a Travel Supplier, a host agency, booking platform, or other party involved in your reservation.

2. Booking and Payment Structure

The payment method and recipient of payment may vary depending on the travel service and booking arrangement.

Your booking confirmation or invoice will identify, where applicable:

  • The party receiving your payment;
  • The amount due;
  • The payment deadline;
  • Any applicable service or planning fee;
  • The applicable Travel Supplier;
  • Deposit and final-payment requirements; and
  • Applicable cancellation and refund terms.

Where payment is made directly to a Travel Supplier or authorized booking platform, that payment may be governed by the applicable supplier’s or platform’s payment terms.

Where The Lux Experience is authorized to collect a service fee or other amount directly from you, that amount will be disclosed before payment.

You should review your booking confirmation carefully to determine which party is receiving each payment and which terms apply to that payment.

3. Travel Supplier and Host/Agency Relationships

The Lux Experience may work with Travel Suppliers, host agencies, consortia, booking platforms, destination-management companies, or other travel-industry organizations.

Where applicable, The Lux Experience may receive commissions, service fees, or other compensation from a Travel Supplier or authorized travel organization for services provided in connection with your booking.

Any such compensation does not change the Travel Supplier’s responsibility for the underlying travel service.

Where a specific law requires disclosure of compensation or other material information concerning a travel recommendation or transaction, The Lux Experience will provide the required disclosure.

4. No Guarantee of Supplier Performance

The Lux Experience will make reasonable efforts to assist you in arranging the travel services you request.

However, because Travel Suppliers are independent businesses, we cannot guarantee that a supplier will:

  • Maintain a particular schedule;
  • Provide a particular room, seat, vehicle, excursion, or amenity;
  • Maintain a particular price;
  • Operate without interruption;
  • Remain in business;
  • Avoid delays or cancellations; or
  • Provide services exactly as originally described.

Where we become aware of a material supplier change, we will make reasonable efforts to notify you and, where our Services include such assistance, help you communicate with the applicable supplier.

5. Acceptance of Booking Terms

A booking request becomes a confirmed reservation only when:

  • 1. The required information has been provided;
  • 2. Any required deposit or payment has been received and successfully processed; and
  • 3. The applicable Travel Supplier has confirmed the reservation.

Submission of an inquiry or booking request does not guarantee availability, pricing, or confirmation.

By making a booking, you represent that:

  • You are at least 18 years old;
  • You have authority to enter into these Terms;
  • The information you provide is accurate and complete;
  • You have authority to provide information for all travelers included in your booking; and
  • You accept these Terms on behalf of yourself and, where applicable, the other travelers included in your reservation.

You are responsible for ensuring that all travelers in your party are informed of the applicable booking terms and restrictions.

6. Travel Supplier Terms

Travel Suppliers may impose their own terms, conditions, cancellation policies, payment schedules, restrictions, and requirements.

These may include terms relating to:

  • Refundability;
  • Deposits;
  • Cancellation fees;
  • Changes;
  • No-shows;
  • Minimum-stay requirements;
  • Check-in and check-out;
  • Airline baggage;
  • Identification and documentation;
  • Resort fees;
  • Taxes;
  • Transportation;
  • Age requirements;
  • Activity restrictions;
  • Health or fitness requirements;
  • Travel insurance; and
  • Other supplier-specific requirements.

You agree to comply with the applicable terms and conditions of the Travel Suppliers included in your itinerary.

Where a Travel Supplier’s terms conflict with these Terms concerning that supplier’s particular service, the supplier’s applicable terms may control that service.

7. Pricing and Availability

All prices, rates, itineraries, schedules, accommodations, transportation arrangements, and availability are subject to change until confirmed and paid as required.

Unless expressly stated otherwise, quoted prices may not include every possible tax, resort fee, service charge, baggage fee, transportation charge, excursion fee, gratuity, or other expense.

Prices may change because of:

  • Supplier pricing changes;
  • Availability;
  • Currency fluctuations;
  • Taxes or government charges;
  • Fuel surcharges;
  • Resort or destination fees;
  • Airline or transportation fees; or
  • Other supplier or government-imposed charges.

Once a booking is confirmed, the price will be governed by the applicable booking confirmation and supplier terms, subject to any permitted changes or additional charges disclosed by the applicable supplier.

We will communicate material pricing changes to you when we become aware of them and when notification is required by applicable law.

8. Deposits and Payments

Many travel reservations require a deposit at the time of booking.

The required deposit, balance-due date, payment schedule, and cancellation terms will be communicated to you before or at the time of booking when reasonably available.

You are responsible for making all required payments by the applicable deadlines.

Failure to make a required payment on time may result in:

  • Cancellation of the reservation;
  • Loss of the deposit;
  • Loss of promotional pricing;
  • Additional fees;
  • Loss of availability; or
  • Other consequences imposed by the applicable Travel Supplier.

The Lux Experience is not responsible for losses caused by your failure to make a required payment by the applicable deadline.

9. Payment Authorization

By providing payment information, you authorize the applicable payment processor or The Lux Experience, as applicable, to process authorized charges associated with your booking.

You agree not to initiate an improper or fraudulent chargeback for a transaction that you authorized.

If you believe a charge is incorrect, you agree to contact The Lux Experience promptly so that we may investigate the matter and, where appropriate, work with the applicable Travel Supplier or payment processor to resolve it.

Nothing in this section limits any rights you may have under applicable law.

10. Cancellation and Refunds

Cancellation policies vary by Travel Supplier and by booking.

Before completing a booking, you should review the applicable cancellation and refund terms.

Some reservations may be:

  • Fully refundable;
  • Partially refundable;
  • Non-refundable;
  • Non-changeable;
  • Subject to cancellation penalties; or
  • Subject to different cancellation terms depending on when cancellation occurs.

If you request cancellation, The Lux Experience will communicate the request to the applicable Travel Supplier when appropriate.

A cancellation is not necessarily effective merely because you have contacted The Lux Experience. The cancellation becomes effective according to the applicable supplier’s cancellation procedures and the terms of the reservation.

Any refund will be subject to the applicable Travel Supplier’s terms and applicable law.

The Lux Experience cannot guarantee a refund where a Travel Supplier’s terms make a booking non-refundable or impose cancellation penalties.

Where The Lux Experience receives funds on your behalf, refunds may be subject to processing by the applicable Travel Supplier or payment processor.

11. Changes to Your Booking

Requests to change a reservation may be subject to:

  • Availability;
  • Supplier approval;
  • Fare or rate differences;
  • Change fees;
  • Administrative fees;
  • Cancellation penalties; and
  • Other supplier-imposed charges.

A requested change is not confirmed until The Lux Experience or the applicable Travel Supplier confirms the change.

You are responsible for reviewing revised confirmations and ensuring that the information is correct.

12. Travel Supplier Changes and Cancellations

Travel Suppliers may change, delay, modify, or cancel travel arrangements for reasons including operational issues, weather, safety concerns, mechanical problems, staffing issues, government actions, schedule changes, overbooking, or other circumstances.

Airlines, cruise lines, hotels, resorts, tour operators, and other suppliers generally control their own schedules and operations.

When we become aware of a supplier change affecting your booking, we will make reasonable efforts to communicate relevant information and assist you in accordance with the scope of our Services.

However, we do not guarantee that a Travel Supplier will operate according to its original schedule or itinerary.

Any refunds, credits, rebooking rights, or compensation arising from a supplier cancellation or change will generally be governed by the applicable supplier’s policies and applicable law.

13. Travel Delays, Interruptions, and Disruptions

Travel involves circumstances that may be outside our control.

These may include:

  • Flight delays or cancellations;
  • Missed connections;
  • Weather;
  • Natural disasters;
  • Government restrictions;
  • Strikes or labor disruptions;
  • Political or civil disturbances;
  • Public-health events;
  • Transportation failures;
  • Road closures;
  • Airport closures;
  • Cruise itinerary changes;
  • Hotel closures;
  • Overbooking;
  • Security incidents; or
  • Other unforeseen circumstances.

The Lux Experience will make reasonable efforts to assist customers with travel disruptions within the scope of our Services, but we do not guarantee that alternative arrangements, refunds, credits, compensation, or reimbursement will be available.

Additional costs resulting from a disruption may be the responsibility of the Traveler unless the applicable Travel Supplier, insurer, or applicable law provides otherwise.

14. Force Majeure

The Lux Experience will not be responsible for failure or delay in performing its obligations to the extent caused by circumstances beyond our reasonable control.

Such circumstances may include natural disasters, severe weather, acts of government, war, terrorism, civil unrest, epidemics or pandemics, transportation disruptions, strikes, labor disputes, supplier failures, power or telecommunications failures, cyber incidents, or other extraordinary circumstances beyond our reasonable control.

This provision does not eliminate rights or remedies that cannot legally be waived under applicable law.

15. Passports, Visas, and Travel Documentation

Travelers are responsible for obtaining and maintaining all required travel documentation.

Depending on the trip, this may include:

  • Valid passports;
  • Visas;
  • Entry permits;
  • Transit visas;
  • Travel authorizations;
  • Vaccination or health documentation;
  • Identification;
  • Parental consent documentation for minors; and
  • Other documents required by airlines, governments, immigration authorities, or Travel Suppliers.

Travel-document requirements can change.

You are responsible for verifying that your documentation satisfies the requirements applicable to your nationality, destination, transit points, and circumstances.

The Lux Experience may provide general travel information or direct you to appropriate official resources, but we do not guarantee admission into any country or territory.

We are not responsible for denied boarding, denied entry, deportation, missed travel, or other losses resulting from inadequate or incorrect travel documentation, except to the extent caused by our violation of a non-waivable legal obligation.

16. Health and Travel Requirements

Travelers are responsible for understanding and complying with health, vaccination, medical, and other requirements applicable to their destination and itinerary.

Travelers should consult qualified medical and governmental resources regarding health requirements and whether a particular trip is appropriate for their individual circumstances.

You should inform us of relevant travel-related requirements when necessary to arrange requested Services.

We do not provide medical advice.

17. Travel Insurance

Travel insurance may provide protection against certain covered events, including certain cancellations, interruptions, medical emergencies, baggage losses, and travel delays.

Travel insurance is subject to the insurer’s policy, exclusions, conditions, deductibles, and claims procedures.

The Lux Experience strongly encourages Travelers to evaluate appropriate travel insurance before departure.

If you decline travel insurance, you acknowledge that you may be responsible for certain losses, cancellation penalties, medical expenses, emergency transportation, or other costs that might otherwise have been covered by an insurance policy.

The Lux Experience is not an insurer and does not determine whether a particular claim is covered.

18. Hotels, Resorts, Cruises, Tours, and Activities

Travel Suppliers establish their own rules concerning accommodations, activities, transportation, safety, age restrictions, accessibility, deposits, incidental charges, and other requirements.

Hotels and resorts may charge additional amounts, including:

  • Resort fees;
  • Taxes;
  • Security deposits;
  • Parking fees;
  • Destination fees;
  • Incidental charges;
  • Early check-in or late check-out fees; or
  • Other charges disclosed by the property or supplier.

Such charges may not always be included in the price paid to The Lux Experience.

Travelers are responsible for complying with the rules of the applicable property, cruise line, tour operator, activity provider, and destination.

19. Accessibility and Special Requests

We will make reasonable efforts to communicate accessibility requirements and other special requests to applicable Travel Suppliers when you provide that information to us.

However, special requests are generally subject to supplier availability and confirmation.

A request is not guaranteed unless the applicable Travel Supplier has expressly confirmed it.

This may include requests concerning:

  • Wheelchair assistance;
  • Accessible rooms;
  • Dietary requirements;
  • Connecting rooms;
  • Bed types;
  • Seating;
  • Transportation assistance; or
  • Other special arrangements.

Travelers should verify important accessibility arrangements directly with the supplier when appropriate.

20. Traveler Information and Accuracy

You are responsible for providing accurate and complete information for every traveler included in your booking.

This includes names, dates of birth, passport information, travel dates, contact information, and other information required to make or fulfill the reservation.

Incorrect information may result in:

  • Additional fees;
  • Booking changes;
  • Denied boarding;
  • Denied entry;
  • Cancellation;
  • Loss of reservation;
  • Missed travel; or
  • Other losses.

The Lux Experience is not responsible for losses resulting from inaccurate, incomplete, or outdated information supplied by you or another traveler, except to the extent caused by our failure to perform an obligation that cannot legally be disclaimed.

21. Photos, Descriptions, and Travel Information

We may provide photographs, descriptions, ratings, amenities, destination information, or other travel information obtained from Travel Suppliers or other sources.

Travel experiences, accommodations, facilities, views, amenities, and conditions may change.

Photographs may be representative and may not reflect the exact room, view, facility, or experience assigned to you.

The Lux Experience does not independently guarantee the accuracy or continued availability of every supplier-provided description, photograph, amenity, rating, or representation.

Where appropriate, we will make reasonable efforts to communicate material information provided to us by Travel Suppliers.

22. Independent Travel Suppliers

Travel Suppliers are independent contractors and are not employees, partners, joint venturers, or agents of The Lux Experience unless expressly stated otherwise.

We do not control the acts or omissions of independent Travel Suppliers.

Accordingly, to the maximum extent permitted by applicable law, The Lux Experience is not responsible for the acts, omissions, negligence, misconduct, representations, services, failures, delays, injuries, losses, damages, cancellations, or changes caused by independent Travel Suppliers.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

23. Traveler Conduct

You agree to behave lawfully and respectfully while traveling and to comply with applicable laws and Travel Supplier rules.

You may be responsible for losses, damage, fees, penalties, or expenses resulting from your conduct or the conduct of members of your traveling party.

Travel Suppliers may refuse service or remove a Traveler from transportation, accommodations, tours, cruises, or activities where permitted by their policies or applicable law.

The Lux Experience is not responsible for consequences resulting from a Travel Supplier’s lawful enforcement of its rules.

24. Minors

A parent, legal guardian, or authorized adult is responsible for minors traveling as part of a booking.

Travel Suppliers may impose additional requirements for minors, including documentation, age restrictions, supervision requirements, or parental consent.

You are responsible for confirming and satisfying those requirements.

25. Fraud and Unauthorized Activity

We reserve the right to decline, suspend, or cancel a booking where we reasonably suspect:

  • Fraud;
  • Unauthorized payment activity;
  • Identity theft;
  • Misrepresentation;
  • Abuse of promotions;
  • Chargeback fraud;
  • Other unlawful activity; or
  • A violation of these Terms.

Where permitted by law, we may provide relevant information to payment processors, Travel Suppliers, financial institutions, law enforcement, or other appropriate parties.

26. Chargebacks and Payment Disputes

Before initiating a payment dispute or chargeback, you agree to contact The Lux Experience regarding any billing concern so that we have an opportunity to investigate and address the issue.

Nothing in these Terms prevents you from exercising rights provided by applicable law or by your payment provider.

Improper or fraudulent chargebacks may result in cancellation of future services or other remedies available to us under applicable law.

27. Limitation of Liability

To the maximum extent permitted by applicable law, The Lux Experience will be responsible only for losses directly caused by our own acts or omissions in providing the Services we have expressly agreed to provide.

To the maximum extent permitted by applicable law, The Lux Experience will not be responsible for losses, damages, delays, cancellations, injuries, expenses, or other consequences caused by an independent Travel Supplier or by circumstances outside our reasonable control.

This may include, without limitation:

  • Airline cancellations or delays;
  • Missed connections;
  • Hotel or resort issues;
  • Cruise itinerary changes;
  • Tour or excursion cancellations;
  • Transportation disruptions;
  • Supplier overbooking;
  • Weather or natural disasters;
  • Government actions or restrictions;
  • Strikes or labor disruptions;
  • Civil unrest;
  • Illness or public-health events;
  • Loss or theft of personal property;
  • Denied boarding or denied entry;
  • Inadequate travel documentation; or
  • Acts or omissions of independent Travel Suppliers.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law, including liability arising from conduct for which a limitation or disclaimer is prohibited.

To the maximum extent permitted by applicable law, The Lux Experience will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to a booking or Service.

Any limitation of liability in these Terms applies only to the extent permitted by applicable law and does not eliminate any statutory consumer rights or remedies that cannot legally be waived.

28. No Guarantee of Travel Supplier Services

The Lux Experience acts as a travel advisor and booking intermediary and does not generally operate the hotels, resorts, airlines, cruises, tours, transportation services, or other travel services included in an itinerary.

Travel Suppliers are responsible for the operation and performance of their respective services.

The Lux Experience does not guarantee the acts, omissions, safety, quality, condition, suitability, availability, or performance of an independent Travel Supplier.

Nothing in this provision is intended to disclaim responsibility for an obligation that The Lux Experience is legally required to perform itself.

29. Assumption of Travel-Related Risks

Travel involves inherent risks and uncertainties, including transportation risks, weather, illness, accidents, activities, unfamiliar environments, and conditions that may differ from those in your home location.

By traveling, you acknowledge that you are responsible for evaluating the risks associated with your itinerary and taking reasonable precautions.

This section does not waive any rights or protections that cannot legally be waived.

30. Indemnification

To the maximum extent permitted by applicable law, you agree to be responsible for losses or expenses caused by your intentional misconduct, fraud, unlawful conduct, material misrepresentation, or material violation of these Terms.

Nothing in this section requires you to indemnify The Lux Experience for losses caused by The Lux Experience’s own conduct where such indemnification would be prohibited by applicable law.

31. Dispute Resolution

If you have a concern or dispute relating to a booking or Service, please contact The Lux Experience first so that we have a reasonable opportunity to investigate and attempt to resolve the matter.

Any dispute that cannot be resolved informally will be handled according to the applicable law and dispute-resolution procedures permitted by the jurisdiction governing these Terms.

Nothing in these Terms prevents a consumer from exercising a non-waivable statutory right or pursuing a claim in a forum where applicable law requires that the claim be heard.

32. Governing Law

These Terms will be governed by the laws of the State of Maryland, without regard to conflict-of-law principles, except to the extent that applicable consumer-protection or other mandatory law requires otherwise.

The parties agree that any dispute will be subject to the jurisdiction and venue of the state or federal courts located in Maryland, except to the extent applicable law requires a different venue or forum.

33. No Waiver of Mandatory Consumer Rights

Nothing in these Terms is intended to waive, eliminate, or restrict any consumer protection, statutory right, refund right, warranty, remedy, or other protection that cannot legally be waived or restricted.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect to the maximum extent permitted by law.

34. Electronic Communications and Records

You agree that The Lux Experience may communicate with you electronically regarding inquiries, bookings, payments, itineraries, changes, cancellations, and other matters relating to your Services.

Electronic communications may include email, text messages, online booking systems, and other electronic methods.

You are responsible for providing accurate contact information and monitoring communications relating to your booking.

You may request paper copies of applicable documents where required by law.

35. Privacy

Personal information provided to The Lux Experience is handled in accordance with our Privacy Policy.

Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information.

By providing personal information to us, you acknowledge that you have had an opportunity to review our Privacy Policy.

36. Changes to These Terms

We may update these Terms from time to time.

The Terms applicable to a confirmed booking will generally be the Terms in effect when the booking is confirmed, unless a change is required by law or otherwise applies to your booking under the applicable Travel Supplier’s terms.

For future bookings, the most recent version posted on the Site will apply.

We may provide additional notice of material changes where required by applicable law.

37. Entire Agreement

These Terms, together with your booking confirmation, applicable Travel Supplier terms, applicable cancellation policies, payment terms, and any other written terms expressly incorporated into your booking, constitute the agreement governing your purchase of the applicable Services.

If there is a conflict between these Terms and mandatory Travel Supplier terms applicable to a particular reservation, the supplier’s terms may control the supplier-specific service.

38. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be modified or limited to the minimum extent necessary to make it enforceable where permitted by law.

The remaining provisions will continue in full force and effect.
